Responsibilities

  • • Law on Energy and Regulation of Energy Activities in the Federation of Bosnia and Herzegovina (Official Gazette FBiH, No. 60/23) Law on Electricity in FBiH (Official Gazette FBiH, No. 60/23); Law on Usage of Renewable Sources and Efficient Cogeneration (Official Gazette FBIH, No. 82/23); Law on Oil Products in the Federation of Bosnia and Herzegovina (Official Gazette FBIH, No. 52/14).
  • Responsibilities
  • The general jurisdictions of the Regulatory Commission are:
    a) issuance of licensees for the performance of energy activities,
    b) supervision of the energy entities to which it issued the license,
    c) adoption of tariff methodologies and determination of prices and fees,
    d) prescribing conditions for third-party access to distribution systems,
    e) passing and giving consent to by-laws and other acts from their jurisdiction,
    f) participation in the implementation of the incentive system for use of renewable energy sources and systems for improvement of energy efficiency,
    g) making binding decisions on issues from its own jurisdiction,
    h) settlement of disputes between market participants,
    i) initiation of misdemeanour proceedings and issuance of misdemeanour orders.
    The responsibilities of the Regulatory Commission are regulated in more detail by special laws regulating the electricity, natural gas, oil products, thermal energy, renewable energy sources and energy
    efficiency.

  • Independence: Independent institution.
  • Supervised by the Parliament.
  • Reports to the Parliament on annual basis.
  • Appeal process: Individual acts made by FERK are final. It is possible to start administrative lawsuit against FERK’s individual acts at court of jurisdiction. The decisions of FERK remain in force pending the completion of appellate proceeding. Award made by FERK in Arbitration in front of FERK has the force of legal valid verdict for the parties.

  • • Parliament of Federation BiH, on proposal of FBIH Government is appointing Chairman and two Commissioners for Regulatory Commission. The process of appointing the commissioners of the Regulatory Commission must ensure the representation of the constituent peoples in the Federation. In accordance with the Law on Energy and Regulation of Energy Activities in the Federation of Bosnia and Herzegovina and Statute of the Regulatory Commission, it is prescribed that the Commissioners may rotate in the post of Chairman. The Chairman’s term of office shall be one year. FERK has the following organisational parts: Licensing and Technical Department, Tariff and Market Department, Legal Department, Financial Department and Department of Common Affairs.

  • Budget
  • One-time fees that are calculated for the implementation of individual procedures from the regulatory authority and regulatory fees as well as other revenues in accordance with the law. FERK’s budget is a three-year budget and is approved every three years. According to the law, if it is not put up for consideration within three months after submission, it is considered adopted.
